Selling a car that failed smog in California starts with the actual test result.
The inspection report matters more than the dashboard folklore. Before approving a repair or arranging a sale, identify whether the vehicle failed an emissions standard or the test could not be completed.

The direct answer
A failed Smog Check does not create one automatic selling path. California rules depend on the vehicle, model year, fuel type, and transaction. A private change of ownership generally requires the seller to provide a valid certification when one is required. Failed is not the same as incomplete
A failed inspection means the vehicle did not meet one or more tested requirements. An incomplete OBD test can occur when required readiness monitors have not completed their self-checks. California BAR notes that recent repairs or a battery disconnect can reset those monitors.
The Vehicle Inspection Report should identify the result. Do not clear codes, disconnect the battery, or attempt to bypass the system to create a sale. If the wording is unclear, ask the licensed station or BAR before deciding what to do next.

The change-of-ownership corner
California BAR says a seller generally must provide a valid Smog Check certification for a private change of ownership when one is required. The buyer, seller, dealer status, family relationship, vehicle age, fuel type, and other facts can affect the rule.
Some exemptions exist, but a short list on a commercial page should never replace the current BAR page. Examples listed by BAR include certain newer vehicles, 1975-and-older gasoline vehicles, older diesel vehicles, electric vehicles, motorcycles, and specified heavy diesel vehicles. Confirm the exact current eligibility before relying on an exemption.

Private sale and licensed-business review are different conversations
A private seller typically manages the certification, disclosure, buyer coordination, and transfer documents directly. A dealer or direct buyer may evaluate the vehicle and transaction under a different business process, but that does not mean every failed-smog car can be purchased in every circumstance.

Title, transfer, and the NRL
The Smog Check result does not replace the title transfer. California DMV explains that ownership and lienholder changes require the applicable transfer documents. Missing titles, liens, inherited vehicles, and branded titles may need additional forms or evidence.
DMV asks a seller to submit a Notice of Transfer and Release of Liability within five calendar days. The NRL records transfer information, but DMV states that it does not itself transfer ownership.
